Terms of Use

Welcome to PostFrames. These Terms of Use (“Terms”) govern your use of the social-media post creation platform available at postframes.co, postframes.io, and related applications (the “Service”), provided by Gawry & Co Servicos LTDA, CNPJ 10.548.738/0001-41, with registered office at Rua Leopoldo, 446, Andaraí, Rio de Janeiro - RJ, CEP 20541-170 (“PostFrames”, “we”).
By creating an account or using the Service, you agree to these Terms and to the Privacy Policy, which form a binding agreement between you and PostFrames. If you do not agree, do not use the Service.
1. Definitions
- User Content: prompts, brand specifications, images, text, logos, and other materials you submit to the Service.
- Designs/Posts: the posts, carousels, stories, images, and captions generated through the Service.
- Organization (Workspace): a workspace holding brands, posts, and members, with owner, admin, and member roles.
- AI Products: features of the Service that use artificial intelligence to generate or refine content.
2. Eligibility
You represent that you are 18 or older and have legal capacity to enter into this agreement. If you use the Service on behalf of an entity, you represent that you have authority to bind it, and “you” includes that entity.
Managed-email accounts. If you sign up with an email associated with an organization (employer, agency), that account may be treated as a managed account, and the organization may obtain administrative control over it, as described in Section 4.
3. Account and security
You are responsible for keeping your credentials confidential and for all activity under your account. Each person must have their own account. Notify us immediately of unauthorized use. We may require identity verification to protect your account.
4. Organizations, roles, and collaboration
The Service lets you create or join Organizations. Owners and admins may invite and remove members, set roles, and manage brands, posts, and permissions within the Organization. Content created within an Organization may be accessed, edited, moved, or deleted by owners and admins. If you do not wish to share certain content, use a separate personal account/organization. PostFrames is not responsible for actions of Organization owners or admins.
5. License to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for professional or personal purposes. We reserve all rights not expressly granted.
6. Plans, subscriptions, billing, and refunds
6.1. Plans. PostFrames offers a free plan and paid plans (e.g., Creator, Studio, and Agency). The free plan may be modified, limited, or discontinued at any time, and we do not guarantee it will remain free. We may also offer trials of paid features.
6.2. AI credits and your own key. Each plan includes an AI-credit allotment. Overage may be subject to additional charges or to using your own API key (“BYO API key”), where available.
6.3. Payment. Payments are processed by Stripe. You authorize recurring charges per your chosen cycle (monthly or annual). You represent that your billing data is true and current.
6.4. Auto-renewal. Subscriptions renew automatically at the end of each cycle, at the then-current price, until you cancel. We will notify you before renewals where required.
6.5. Cancellation. You may cancel anytime in account settings. Cancellation takes effect at the end of the current billing cycle; except as required by law or under clause 6.7, no refunds are due for the current period already paid.
6.6. Price changes. We may change prices and plans. Increases apply only from the next renewal or 30 (thirty) days after notice, whichever is later. If you disagree, you may cancel.
6.7. Right of withdrawal (Consumer Code). If you are a consumer purchasing online, you may exercise the right of withdrawal within 7 (seven) days of contracting, under art. 49 of the Brazilian Consumer Defense Code, with a refund of amounts paid. To do so, write to help@postframes.co.
6.8. Taxes. Amounts may include applicable taxes, per law and your billing address.
7. User Content
7.1. Ownership. You retain all rights to your User Content. We acquire no ownership of it.
7.2. License to PostFrames. You grant us a worldwide, non-exclusive, royalty-free, sublicensable (to processors) license to host, store, reproduce, display, and process your User Content, solely to operate, maintain, protect, and improve the Service and to generate the Designs you request.
7.3. Warranties. You represent and warrant that you hold the necessary rights to your User Content and that it does not violate third-party rights or the law.
7.4. AI and Service improvement. As stated in the Privacy Policy, we do not use your User Content to train AI models.
8. AI-generated content
8.1. Ownership of outputs. As between you and PostFrames, generated Designs are yours, to the extent permitted by law and by AI providers’ terms.
8.2. Nature of AI. AI outputs may be inaccurate, generic, or similar to others, and we do not warrant originality, accuracy, fitness for a particular purpose, or non-infringement of third-party rights. You are responsible for reviewing and verifying the suitability of Designs before publishing or using them commercially.
8.3. Provider restrictions. Use of AI Products may be subject to the policies of underlying providers (Section 11 of the Privacy Policy).
9. Acceptable Use Policy
You agree not to use the Service to, nor allow third parties to:
- violate laws, third-party rights (including intellectual property, image, and personal data), or these Terms;
- create or distribute unlawful, defamatory, fraudulent, deceptive content, or content that incites hatred, violence, or discrimination by race, religion, gender, sexual orientation, age, disability, origin, or nationality;
- produce sexual content involving minors, or any child sexual abuse material (absolute prohibition);
- engage in spam, phishing, or send unsolicited communications;
- transmit viruses or malicious code, or compromise the security and integrity of the Service;
- reverse engineer, decompile, or attempt to obtain the source code, except to the extent permitted by law;
- scrape, mine, or automatically harvest data or content from the Service without authorization;
- circumvent usage limits, quotas, technical or billing measures;
- use the Service for benchmarking or to build a competing product;
- resell, sublicense, or make the Service available to third parties beyond what is permitted.
Violations may lead to content removal, suspension, or account termination (Section 14), plus any applicable legal remedies.
10. PostFrames intellectual property
The Service, its brand, software, interfaces, and content provided by PostFrames are protected by intellectual property rights and belong to PostFrames or its licensors. You assign to PostFrames any suggestions and feedback you provide, which we may freely use to improve the Service.
11. Third-party services
The Service may integrate with third-party services (e.g., Google login, Stripe, AI providers, publishing integrations). Use of those services is subject to their own terms and policies. PostFrames is not responsible for third-party services.
12. Disclaimer of warranties
To the maximum extent permitted by law, and without prejudice to non-waivable consumer rights, the Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, or meet all your expectations.
13. Limitation of liability
To the maximum extent permitted by law, and without prejudice to consumer rights under the Consumer Defense Code, PostFrames is not liable for indirect damages, lost profits, or loss of data or opportunities. PostFrames’ total aggregate liability in any case is limited to the greater of (i) the amounts you paid PostFrames in the 12 (twelve) months before the triggering event and (ii) BRL 500. These limits do not apply to willful misconduct, fraud, or where the law prohibits limitation.
14. Term, suspension, and termination
These Terms apply while you use the Service. You may close your account at any time. We may suspend or terminate your access, with or without notice, for breach of these Terms, the Acceptable Use Policy, legal requirements, or security risks. After termination, you may lose access to Designs and User Content; we may delete them, except where retention is legally required. Clauses that by their nature should survive (ownership, IP, limitation of liability, indemnification, jurisdiction) remain in effect.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold PostFrames harmless from claims, losses, and expenses (including reasonable fees) arising from your User Content or your breach of these Terms or the law.
16. Changes to the Terms and the Service
We may change these Terms and the Service. We will communicate material changes by email and/or notice in the Service, with reasonable advance notice. Continued use after they take effect constitutes agreement. If you disagree, you must stop using the Service.
17. Communications
You agree to receive Service-related communications (security, billing, notices) by email or within the Service. Marketing communications may be opted out of at any time.
18. Governing law and jurisdiction
These Terms are governed by Brazilian law. The courts of the Comarca da Capital do Estado do Rio de Janeiro/RJ are elected to resolve disputes, without prejudice to the consumer’s right to bring suit in their own domicile (art. 101, I, of the Consumer Defense Code).
19. General provisions
- Assignment: you may not assign these Terms without our consent; we may assign them in a corporate reorganization.
- Severability: the invalidity of one clause does not affect the others.
- Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties.
- Language: in case of conflict between versions, the Portuguese version prevails.
